PAWSSENGERAIR PARTICIPANT AGREEMENT
1. GENERAL
By purchasing a seat on a flight arranged by PawssengerAir (operating under PawssengerAir Sdn Bhd ), you agree to the terms and conditions set forth below. PawssengerAir acts as a Charter Broker and Aggregator, organizing shared charter flights for pets and their owners.
The price of your trip, flight dates, origin, destination, and itinerary are specified in your Booking Confirmation. These terms constitute the entire agreement between you (the "Participant") and PawssengerAir.
2. RESERVATIONS & PAYMENTS
- Booking Process: Reservations are made directly through PawssengerAir. Upon booking, our team will review your identification and your pet’s details.
- Confirmation: Shared Charter flights are crowd-funded. Your reservation is considered "Pending" until the minimum passenger threshold for the route is met.
- Payment: Payments are held in a secure Client Account. If the flight is confirmed (minimum pawssengers reached), your funds are allocated to the charter cost. If the flight does not reach the minimum number by the confirmation deadline (typically 30 days prior to departure), you will receive a full refund.
- Final Confirmation: You will receive an official "Flight Confirmation" email once the route is secured.
3. AIR TRANSPORTATION
PawssengerAir does not own or operate aircraft. All flights are performed by fully licensed and insured third-party Air Carriers (the "Operator").
- Aircraft: Flights are typically operated using Heavy Jets (e.g., Gulfstream, Bombardier Global, or similar) to ensure comfort and range.
- Substitutions: PawssengerAir and the Operator reserve the right to substitute the aircraft type or operator if necessary to ensure the flight proceeds.
- Status: PawssengerAir acts as the agent for the Participant in arranging transportation.
4. CHECK-IN & BOARDING
- Time: Passengers must present themselves at the private terminal (FBO) at least sixty (60) minutes prior to the scheduled departure time.
- No-Show: If you are not present at least thirty (30) minutes prior to departure, you will be considered a "No-Show." The flight cannot wait, and no refund will be provided.
5. CANCELLATION BY PAWSSENGERAIR
- Crowd-Funding Limit: If the flight does not meet the minimum passenger count by 30 days prior to departure, PawssengerAir reserves the right to cancel the route. In this specific case, you will receive a 100% refund of all monies paid.
- Force Majeure: If a flight is cancelled due to reasons beyond our control (weather, war, pandemic, ATC restrictions), our sole liability is to refund the amount paid for the cancelled flight segment.
6. CANCELLATION BY PASSENGER (YOU)
Due to the shared nature of these flights, your ticket price relies on the participation of others. Therefore:
- Non-Refundable: Once a flight is "Confirmed" (minimums met), tickets are non-refundable.
- Replacement Policy: If you cancel, a refund is only possible IF we can resell your seat to another traveler on the waiting list. An administrative fee of $500 USD will be deducted from any such refund.
7. BAGGAGE ALLOWANCE
- Allowance: Each seat purchased includes a baggage allowance of 30kg (checked) plus one small carry-on item.
- Restrictions: Due to strict weight and balance regulations on private jets, overweight luggage may not be accepted or may incur significant fees. Please adhere strictly to the guidelines sent in your Flight Briefing.
8. LIABILITY & RESPONSIBILITY
- Role: PawssengerAir acts solely as an aggregator and charter broker. We are not an air carrier.
- Liability: PawssengerAir is not liable for injury, damage, loss, accident, delay, or irregularity which may be occasioned either by reason of defect in any vehicle, or through the acts or defaults of the Air Carrier or any company conveying the passengers.
- The Operator: The Air Carrier (Operator) maintains full operational control of the aircraft and holds sole responsibility for the safety of the flight.
9. IDENTIFICATION & TRAVEL DOCUMENTS
- Humans: You must hold a valid passport with at least 6 months of validity and any necessary visas for the destination country.
- Pets: You are responsible for having all required "Dogcuments" (Import Permits, Health Certificates, Vaccination Records) ready for inspection.
- Denial: Failure to provide correct documents for you or your pet will result in denied boarding without refund.
10. PET SAFETY & CONDUCT (THE "NO CRATE" POLICY)
- Cabin Freedom: Pets are permitted to be crate-free in the cabin during the cruise phase of the flight.
- Restraint during Takeoff/Landing: For safety, all dogs must be secured using a safety harness attached to the seatbelt, or remain on a leash at the owner's feet during taxi, takeoff, landing, and turbulence.
- Leashes: Dogs must be leashed at all times in the airport terminal and when boarding/deplaning.
- Safety Gear: Owners must carry a muzzle in their carry-on luggage. While we do not require dogs to wear them, the Captain reserves the right to request a dog be muzzled if they pose a safety risk to crew or other passengers.
- Cats: For their own safety, cats must remain in an appropriate carrier for the duration of the flight.
11. "DOGCUMENTS" (PET DOCUMENTATION)
While PawssengerAir provides complimentary guidance on import requirements, compliance with all laws is the full responsibility of the owner.
- You confirm that your pet is healthy, fit to fly, and meets all entry requirements for the destination.
- Any fines, quarantine costs, or repatriation costs incurred due to missing or incorrect paperwork will be borne solely by the Participant.
12. APPLICABLE LAW
This agreement shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under this agreement shall be settled in the courts of Kuala Lumpur.
13. CAPTAIN'S AUTHORITY
The Pilot in Command (Captain) has absolute authority. If the Captain determines that a passenger or a pet poses a safety threat, creates a disturbance, or is unfit for travel, the Captain may refuse transportation. In such an event, no refund will be provided.
14. ACKNOWLEDGEMENT
By purchasing a ticket, the Participant confirms they have read, understood, and agreed to these terms, and they represent that they are not a sanctioned individual prohibited from travel under international law.
