PAWSSENGERAIR TERMS OF SERVICE

1. ACCEPTANCE OF TERMS
Welcome to PawssengerAir (operated by PawssengerAir Sdn Bhd). By accessing our website, using our services, or booking a flight, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use our services.
2. NATURE OF SERVICES (CRITICAL)
It is important to understand how PawssengerAir operates:
- We are not an Air Carrier: PawssengerAir acts solely as a Charter Broker and Aggregator. We do not own or operate aircraft.
- The Operator: All flights are performed by third-party, fully licensed, and insured Air Carriers ("Operators") who maintain full operational control of the aircraft.
- Your Relationship: PawssengerAir acts as your agent to arrange air transportation. By booking with us, you authorize us to enter into a charter contract with the Operator on your behalf.
3. BOOKING & "CROWD-FUNDED" FLIGHTS
PawssengerAir offers both Private Charters (booking the whole jet) and Shared Charters (booking individual seats).
For Shared Charters:
- Confirmation: Flights are confirmed only when the minimum passenger threshold is met.
- The Timeline: Routes are typically confirmed 30 days prior to departure.
- Refunds if Unconfirmed: If the flight does not reach the minimum number of passengers, PawssengerAir reserves the right to cancel the route. In this event, you will receive a 100% refund of all funds paid.
4. PAYMENT TERMS
- Deposit: A deposit is required to secure your reservation.
- Balance: The remaining balance is due as per the schedule provided in your invoice (typically 90 - 180 days prior to departure).
- Failure to Pay: Failure to pay the balance by the due date will result in the cancellation of your booking and forfeiture of your deposit.
- Currency: All payments are processed in USD.
5. CANCELLATION & REFUND POLICY
Because shared private aviation relies on collective funding, our cancellation policy is strict:
- Client Cancellation: Once a flight is confirmed, tickets are non-refundable.
- Seat Resale: If you must cancel, a refund (minus an administrative fee) will only be issued if PawssengerAir is able to resell your seat to another passenger on the waitlist.
- Flight Delays: PawssengerAir and the Operator are not liable for delays caused by weather, air traffic control, or mechanical issues. We will work to reschedule the flight, but no financial compensation for delays will be provided unless required by applicable aviation law.
6. PET ELIGIBILITY & "DOGCUMENTS"
You represent and warrant that your pet is fit for travel.
- Health: Your pet must have up-to-date vaccinations and be free of contagious diseases.
- Behavior: We welcome all breeds, but we do not accept pets with a history of aggression. If a pet displays aggressive behavior pre-flight, the Captain has the authority to deny boarding. No refund will be provided.
- Documentation: You are responsible for obtaining all necessary "Dogcuments" (Import Permits, Health Certs, Passports) for the destination country. PawssengerAir provides guidance, but compliance is the sole responsibility of the owner. Denied entry due to paperwork errors is not grounds for a refund.
7. SAFETY & CONDUCT ONBOARD
- Captain's Authority: The Pilot in Command (Captain) has absolute authority over the safety of the flight. All passengers (human and canine) must follow crew instructions.
- Restraint Policy: While we do not use crates, dogs must be secured via a safety harness attached to the seatbelt during taxi, takeoff, landing, and turbulence. Dogs are free to roam only during the cruise phase at the Captain's discretion.
- Damage: You are financially responsible for any damage caused by you or your pet to the aircraft interior (e.g., chewing seats, soiling carpets beyond standard cleaning).
8. BAGGAGE
Due to the weight restrictions of private aircraft, baggage allowances are strictly enforced.
- Standard Allowance: [30kg] Checked Bag + [1] Personal Item per seat.
- Oversize items: Large items (golf clubs, strollers) must be approved in advance and may incur extra fees.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by Malaysian law:
- PawssengerAir shall not be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental, or consequential damages of any kind, whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with the use of our services or the flight itself.
- Liability for the flight operation rests solely with the Air Carrier (Operator).
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless PawssengerAir, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party (including damage caused by your pet).
11. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur.
